@Robee: Because enforcing copyright is the responsibility of individual copyright holders, I doubt there is one single reason that applies in all cases. I can think of several reasons why they might not bother. One is simply that bringing a lawsuit requires money, time, and effort that the copyright holder isn't going to get back even if he/she/they win the suit (even if they bring it in a country where the loser normally pays the winner's legal costs, most fanfic writers aren't exactly wealthy). Another is the fact that your typical fanfic writer or archivist will pull things off the 'Net when faced with a simple "Cease and Desist" letter, long before anything reaches lawsuit territory (and there have been a few cases in which such letters have been sent, I believe). Some may not want to alienate their fans. Some may even carefully avoid finding out if fanfic for their creations exists, because then they'd feel they had to do something about it (this is likely to especially be the case where there's a trademarked character or the like involved, because if you're aware of an infringement on your trademark you must challenge it or risk losing the trademark--it isn't like copyright). And, yes, it's possible that some might be flattered. Writing good fic for an obscure work may even give a (very slight) boost to the popularity of the original--for all but the most popular works, what prevents them from making more money is obscurity, not intellectual property rights violations. Note, please, that I do know of one case a few years back where a Japanese doujinshika landed in jail for writing hentai Pokemon doujinshi, but like most doujinshika, she was distributing her creation commercially right under the noses of the copyright holders, and they apparently were deeply disturbed by the type of hentai she was writing (and it was still considered somewhat poor form by the public for them to drag her into court, which may be why no one else has done it since). That's the closest thing I know of to someone actually going to court for writing fanfic.
Oh thank god there's a discussion about copyrights. I don't want to get sued for plagiarism or whatever. I'm thinking of making a Kyou Kara Maou fanfic due to requests of a couple of friends and paranoia is kicking in that maybe making fanfics out from that story may be illegal. I just had a weird feeling that the deletion of some episodes from Kyou Kara Maou may be somewhat related to making a fanfic from KKM. If it doesn't make sense to you, it doesn't to me either. I just have an odd prediction. But about copyrights, hey, I got to be wary and keep caution. So, if there is anyone that has any idea that they'd wish to inform me or advise me, please feel free to send me a message or just post the reply in this group. I would really appreciate it.
